Terms and Conditions (GTC)
1. Scope
The present general terms and conditions (hereinafter "GTC") apply to all legal relationships of the Bar Spirit Strobl, Reinacherstrasse 12, 4053 Basel, Switzerland (hereinafter "Bartender Moments") for the purchase of goods and services from the range of Bartender Moments when purchasing via the Online shop at the URL.
Bartender Moments provides its services exclusively on the basis of these terms and conditions. Deviating terms and conditions of the customer as well as changes and additions to these terms and conditions are only valid if they have been recognized in writing by Bartender Moments. In these cases, these terms and conditions apply in addition.
When using this website or ordering products in the Bartender Moments online shop, the customer confirms that he fully accepts these terms and conditions, including delivery and payment conditions.
The offer in the online shop is only valid for people residing in Switzerland.
2. Assortment
The current range of Bartender Moments can be found at www.bartender-moments.com. The offer contained therein is without obligation. The range and offer can be adjusted at any time by Bartender Moments. The information in the online shop (e.g. product descriptions, images, sizes and other information) do not represent any assurance of properties or guarantees, unless explicitly stated otherwise.
3. Prices
The prices stated at the time the goods are ordered are decisive. All prices for the goods stated in these terms and conditions, in the offer, in the order confirmation and in the contract are understood to be the price including the statutory VAT rate applicable at the time of invoicing.
4. Registration / data protection
In order to complete an order process, the customer must enter his personal details on the Bartender Moments website. The customer undertakes to use truthful information.
Bartender Moments attaches great importance to the protection of your data. The details can be found in the separate data protection provisions on the website www.bartender-moments.com .
5. Binding nature of the order
The offer in the Bartender Moments online shop is an invitation to submit an offer. Your order to Bartender Moments via the Bartender Moments online shop, by phone, email, etc. is binding. As soon as the order has been received by Bartender Moments, this is considered an offer and can be accepted by Bartender Moments at any time, whereby the contract is concluded. Bartender Moments notifies the customer of the conclusion of the contract by means of an order confirmation by email. Cancellation of the order by the customer is only possible in consultation with Bartender Moments.
Orders in the online shop to a delivery address outside Switzerland are not possible (see section 7 below for ordering options with a delivery address outside Switzerland).
6. Payment options
Payment can be made either by credit or debit card.
We accept the credit and debit cards specified in the Bartender Moments online shop. When you return the goods you have ordered, the amount will be credited back to your credit or debit card account.
7. Delivery / delivery times / delivery costs
The Bartender Moments online shop only delivers within Switzerland.
7.1 Delivery times:
Bartender Moments offers the products subject to availability. If a product is not or no longer available, the customer will be informed accordingly as soon as possible in a suitable form. Bartender Moments reserves the right to withdraw from the contract should products no longer be available through no fault of Bartender Moments. Available goods are usually dispatched within three working days of receiving the order. The estimated delivery times are guidelines. Bartender Moments is not liable for delivery delays through no fault of their own, e.g. due to force majeure, traffic jams, strikes, bad weather conditions, etc., and they do not entitle the customer to withdraw from the purchase contract or to compensation. Longer parcel delivery times must be expected before public holidays (Easter, Christmas). If it is not possible to send all the items ordered within ten days of receipt of the order, a partial delivery will be made by Bartender Moments. In the case of partial deliveries, Bartender Moments bears the additional packaging and shipping costs.
7.2 Delivery costs:
The dispatch is carried out by the Swiss Post. Within Switzerland, the shipping costs are CHF 11.00 up to a value of CHF 120.00. From a purchase value of 120.00 CHF, we send the goods free of charge. The packaging and shipping costs are displayed in detail before the order is placed and shown separately on the invoice / order confirmation.
Bartender Moments is not liable in the event of undeliverability or late delivery of the goods due to incorrect specification of the delivery address by the customer or the absence of the recipient.
8. Notification of defects
The customer is required to check the goods for completeness or damage. Any damage must be reported in writing within 8 days of receipt of the goods (to Bartender Moments by email or post). An exchange is only possible in the case of manufacturing defects.
9. Right of return / costs for return / refund
Your satisfaction is our top priority. However, if you do not like your order, you can of course return it to Bartender Moments within 14 days at your own expense. The prerequisite for this is that you return the goods complete, unopened, in perfect condition and in the original packaging. 9.1 Return costs:
The costs for the return are borne in full by the customer.
9.2 Refunds
As soon as we have received the return and checked it, we will refund the amount to you. For this refund, we will use the same method of payment that you used in the original transaction.
Refund by credit card:
The refund will be made automatically to the account used when the order was placed.
10. Wrong delivery
Bartender Moments must be informed immediately if goods are delivered that do not correspond to the ordered sizes or the ordered article numbers.
Delivered goods can only be exchanged when they have not been used or washed. We ask you to check the delivered items.
In the event of errors in the entry or shipping on the part of Bartender Moments, a subsequent delivery will be made free of charge. If the error is in the customer's order, the shipping costs for the new delivery will be sent to the customer.
If the item is no longer available, the customer will receive a credit note from Bartender Moments in the amount of the value of the goods already paid for. No credit will be issued for any flat-rate shipping costs.
Any returns are only possible after prior consultation with Bartender Moments.
11. Intellectual property
All rights to the website, the Bartender Moments online shop as well as their content, products, logos, etc. are either owned by Bartender Moments or have been licensed to Bartender Moments by third parties. Existing intellectual property rights, such as copyrights, trademarks and other intellectual property rights, belong exclusively to Bartender Mometns or the licensors of Bartender Moments. This content may only be used by the customer in connection with the use of the website or the online shop and may not be downloaded, copied, reproduced, distributed, transmitted, sent, presented, licensed or for any other purposes without the prior written consent of Bartender Moments be used.
12. Final provisions
If a provision of these terms and conditions is ineffective, the remaining provisions remain unaffected by this ineffectiveness. The ineffective provision will be replaced by one that comes closest to the meaning and purpose of the ineffective provision in a legally effective manner. The same applies to possible regulation gaps. Bartender Moments reserves the right to change these terms and conditions at any time.
